Why isn't my foreign divorce automatically recognized in Brazil?

Brazil is a sovereign nation and does not automatically enforce foreign court judgments. Under private international law, the sovereignty of Brazilian civil records requires foreign judgments to undergo a verification process (either at a cartório or the STJ court) to ensure they comply with local laws and public policy.

What is the difference between direct Cartório registration and STJ court cases?

Direct Cartório registration is a simplified process introduced in 2016. It is only permitted for consensual divorces that strictly dissolve the marriage without deciding on asset distribution, custody, or alimony. Any divorce that was litigious, or decided on property/kids, must be homologated by the STJ.

Do I need my ex-spouse's consent to homologate the divorce?

No. Consent makes the process faster because both parties sign a consent declaration. If your ex-spouse refuses to cooperate or cannot be found, we file a litigious homologation action. The STJ will serve them international judicial notice, and the case will proceed to approval regardless of their opposition.

How long does the recognition process take?
